【摘要】 在国土及城乡空间区划管理的多部门分治的背景下,主体功能区划、生态功能区划、空间管制区划等多种区划方式积极创新,但在体系化和法制化两方面存在关键问题,突出表现在政出多门、法源依据不充分、缺乏整体的逻辑框架,导致了具体依法行政的悖论。基于建设法治化社会和政府主导管理的背景,通过对依法行政和区划管理的内涵解析,试图提出多部门协作、结构有机的依法区划行政管理体系,使多部门的分治能够在统一的逻辑框架下协作,并建议进行专门性的"国土及城乡空间区划法"的立法,为多部门的协作搭建统一的法源框架。更多还原

【Abstract】 Under a background of multi-departments controlling the territory,urban and rural spatial zoning administration,several kinds of zoning modes,such as main function area zoning,ecological function area zoning,and spatial administration zoning,etc have been innovated.However,critical problems still exist in systematization and legalization,such as same policies developed by different departments, lack of legal basis and lack of logical framework,which leads to a paradox of administration practice in accordance with laws.Based on the background of constructing a legal society and maintaining the predominant leading administration function of governments,by explaining the contents of practicing administration according to laws and zoning administration,this paper forwards departmental coordinative zoning administration system which can realize cooperation under a same logical framework and suggests that a specific legislation on"The Code of Territory, Urban and Rural Spatial Zoning"so as to provide a legislative framework for multi-departmental cooperation.更多还原
