【摘要】 我国农地产权的实质是其二元属性;即涉及到农业用途时,农民享有所有权;而涉及到非农用途时,国家享有所有权,地方政府代替国家行使这种权利。城市化进程中,地方政府的征地行为有两个特点:一是地方政府有强烈的寻租动机;二是我国在既定的发展战略及由此内生的政绩考评体系导致地方政府大力吸引外资和竞相发展本地经济。这两点使得地方政府在征地中有强烈的过分掠夺动机,而二元农地产权则使得过分掠夺成为现实。要解决此问题,关键是改变我国赶超型发展战略,稳健推进市场化改革,完善合理的政绩考评体系。更多还原

【Abstract】 The nature of rural land’s property rights is of dual attributes: When it comes to agricultural purpose,the property rights belong to peasant;when it comes to non-agricultural purpose,they belongs to the state,which give the rights to the local government.China’s big-pang development strategy and political evaluation system lead to particular activity of local government: pursuing FDI and developing local economy with malignant competition which inducing incentives of over-predatory,then rural land’s dual property rights make over-predatory behavior become true.At last,we give some suggestions on the problem.The criticality and importance is changing China’s development strategy from big-pang to relying on comparative advantage,continuing market-oriented revolution steadily,restructuring political evaluation system scientifically,which will decrease the over-predatory behavior of local government.更多还原
