【Abstract】 Correction is regarded as the important system of penalty and the important means of socialization in theory and practice of penalty. This kind of understanding that penalty means correct offenders confused the relation between penalty and correction. The heterogeneity of penalty and correction is showed: the relation between penalty and free sentence, interpreting the penalty of labor, the rational analysis of penalty independence of correction, the confusion of penalty and correction and so on. The theory of independence of penalty of correction is the key of solving the controversy of the theory that penalty in essence is a kind of retribution and correction.更多还原
