【Abstract】 Since the Hong Kong Basic Law is drafted, the "residual power" issues become the focus of interest in theory and practice. This essay attempts to analyze the connotation of residual power and to differentiate it as the reserved power and as the omitted power. Based on the comparative constitution jurisprudence, the essay expounds that with the high degree autonomy in Hong Kong SAR, the residual power is groundless in either constitutionalism theory or in positive laws. Further, this essay explicates the legitimate path for further development of the high degree autonomy in Hong Kong SAR.更多还原
