【摘要】 我国的农家乐自产生之初就与农村宅基地结上不解之缘,也因此出现农家乐土地与农村宅基地混用的普遍现象,本文对于农家乐是占用还是利用农村宅基地,就其占用农村宅基地进行经营的现象是否合法等问题,从两种用地的区别研究中做出评析,得出农家乐利用农村宅基地发展合理不合法,将农家乐利用农村宅基地合法化并促进农家乐的发展是大势所趋,完全符合我国"十一五"规划目标,笔者因此提出了区别规制的建议。更多还原

【Abstract】 Rural amusement business bases in our country,from the beginning,have mixed with rural house bases.This article distinguishes the rural amusement business bases from the rural house bases and comes to the conclusion that it is reasonable but illegal to develop rural amusement business on the base of rural house bases.It is a trend to promote the legalization of rural amusement business occupying rural house bases,which matches the requirement of the Eleventh Program.At the some time,some relevant suggestions are put forward in this article.更多还原
