试论网络虚拟财产的法律性质

【摘要】 网络虚拟财产是指网民、网络游戏玩家在网络中的数据财产,其性质的界定对于保护网络游戏玩家的合法权益非常重要。本文列举了目前对虚拟财产性质的不同观点,并通过对这些观点的进一步分析,认为网络虚拟财产在性质上是一种物权化的债权,应当对其进行相应的法律规范。更多还原

【Abstract】 The virtual property are some electronic digits or electromagnetic records reserved in the server of the network.It has some theoretic and realistic basis to think the virtual things as a new brand of property.It is extremely important to limit its nature.All views on the virtual things was listed and analyzed in this paper.The legislation should consider the special regulation of network technology so that the protection can be featured and the corresponding legal standard can be carried on it.更多还原
