【摘要】 《道路交通安全法》第76条规定,保险公司在机动车第三者责任强制保险责任限额范围内赔偿交通事故造成的人身伤亡、财产损失,但赔偿的对象未加明确,之后颁布实施的《机动车交通事故责任强制保险条例》也未予界定。基于保护受害人利益的立法目的,建议修改《道路交通安全法》,直接确认保险人对机动车交通事故受害人的直接给付责任,赋予第三人对保险公司的直接赔偿请求权。更多还原

【Abstract】 Article 76 of law on road traffic safety regulates compensation of insurance company for personal casualty and property loss induced by traffic accidents.However the subject of compensation is uncertain.Neither do regulations on forcible insurance of responsibilities for motor vehicle traffic accidents promulgated.For the purpose of the interests of victims,it is recommended to modify law on road traffic safety to identify direct compensation responsibility for the insurer to victims of motor vehicle traffic accidents and indentify the direct petition for compensation for the third party to the insurance company.更多还原
