【摘要】 民事案件执行难问题一直是司法实践中的痼疾,而我国现阶段既有的民事执行监督体系又缺乏一种强有力的外部制约机制,而民事执行检察监督制度的创建则可以很好地解决这个现实难题。文章在分析我国民事执行监督现状的基础上,阐述了在我国建立民事执行检察监督制度的必要性和法理依据,并从民事执行检察监督程序启动模式的限定、民事执行检察监督范围的界定与民事执行检察监督方式的规定三个方面,探讨创建民事执行检察监督制度的具体程序设计。更多还原

【Abstract】 The problem caused by the difficultly in executing the civil case is a chronic disease in the judicial practice.But the present civil executing supervision system lacks a powerful exterior restriction system;the establishment of the prosecutorial supervision system for civil execution may be a good solution to this problem.Based on an analysis of the present situation of our country’s prosecutorial supervision of civil execution,this paper elaborates the necessity and the legal principles for establishing this system and discusses the concrete procedures for founding the prosecutorial supervision of civil execution from three aspects,namely the starting pattern,the scope limit and the way of implementing the prosecutorial supervision of civil execution.更多还原
