【摘要】 污点证人作证豁免制度是现代西方国家,特别是英美法系国家刑事司法制度中的重要制度。污点证人作证豁免有其必要性及合理性,我国应借鉴这一先进的司法制度,建立起适合中国国情的作证豁免制度,以便更好地打击犯罪、保障人权。我国建立的污点证人作证制度应选择的作证豁免类型是罪行豁免,应由检察机关自行决定是否对证人实行豁免,应建立相应的证人保护机制、惩戒机制等相关制度。更多还原
