【摘要】 我国对待死刑的政策是"少杀、慎杀"。1979年刑法典对死刑持非常谨慎的态度,除了在分则中极力控制死刑外,还有总则中对死刑的适用作了严格的限制。1997年刑法典除了在总则编中对死刑的适用对象作了更精确的表述,并对死缓制度作了进一步的完善以外,在分则编对可处死刑的罪种数量略有减少。但是我国死刑适用的范围客观地说是比较宽泛的,在当今世界各国刑法中也是不多见的。更多还原

【Abstract】 The present Chinese death punishment policy"to kill less and cautiously".The Criminal Law in 1979 was discreet in the provision of death penalty.The crimes punishable by death in specific provisions were strictly limited and strict restrictions of the application of death penalty were made in general provisions.The general provisions of Criminal Code in 1997 stipulated the criminals to whom death penalty can be applied to more exactly and further perfected the system of death sentence with a reprieve.The number of crimes punishable by death decreases.The scope of application death penalty in China is wide,which is particularly obvious at present.更多还原
