【摘要】 在现行的道路交通事故伤残评定标准(GB18667-2002)中,伤残等级划分是以受伤人员生活、工作和社会活动能力的不同程度丧失为依据的,没有充分考虑未成年人的生活、工作和社会活动能力尚未具备或完全具备的现实,而对未成年人和成年人的伤残评定做出统一规定,这不免损害了未成年人的合法权益。因此,应当从未成年人的实际情况出发制定一套适用于未成年人的伤残评定标准,或修订现行标准:制定"同伤不同级"、"同级不同赔"的规定,或在评定工作中合理延长未成年人的评定时间。同时,对未成年人的心理问题应引起足够重视,并在标准中有所体现。更多还原

【Abstract】 the assessment standards of the impairment in road traffic accident(GB18667-2002), in which the impairment is divided into some degrees. It is concentrated on the loss of the abilities which influence their life, work and social activities. In most cases, it concerns the adult, but not enough for the minor. In reality, the ability of the minor is not good enough as the adult when a traffic accident happens. It might be not good enough to protect the right of the minor when this standards is executed. Therefore we need to establish a special standards for the minor, or modify the executing standards: The assessment degrees of the minor are not same as the adult’s when the impairment happens in both, the compensation is not same when the degrees are same in both, and put off the period reasonably in assessing the impairment of the minor.
