【摘要】 公立高校投资主体的多元化要求建立与之相适应的现代产权制度。根据现代产权制度下公立高校产权清晰的要求来考察我国的公立高校产权现状,可知,我国公立高校产权有如下两个特征:一是投资主体逐步多元,但产权所有者仍虚置;二是公立高校未成为独立法人财产权主体。所以,谈论投资主体与公立高校间产权清晰的前提是缺位的。因此,要在我国公立高校中建立现代产权制度,可以从以下两个方面着手:一是设立独立于政府之外的公立高校理事会,明晰公立高校投资主体(或称为教育财产所有者)财产权利,以促进公立高校产权结构多元化;二是通过规章和交易的途径改革公立高校内部的权利机制,建立公立高校内部的科学治理结构。更多还原

【Abstract】 With the diversification of investors of public higher education institutions it needs set up modern property right system. According to the demands of clear property rights of modern property right system we can know that there are two characteristics in the public higher education institutions’ property rights of our country: first, with the diversification of investors of public higher education institutions the owner of property rights still empty; second, the public higher education institution has not become the independent legal persons proprietary subject. So, to set up modern property right system in the public higher education institutions of our country we should do as follows: first, make clear of the property right of the investors; second, set up the scientific administration structure through reforming the right mechanism inside the public higher education institution.更多还原
