金融衍生品市场统一监管法律制度的构建

【摘要】 本文在分析了既有金融监管模式对金融衍生品市场监管的局限性后,提出了统一监管模式,对其结构、体系、实施基础和比较优势进行了具体探讨。在此基础上,本文提出了构建我国统一监管法律制度的设想,认为我国应先成立监管协调委员会,并将其作为单一制监管组织机构的过渡形式,渐进式地发展统一监管制度,这是一种成本较低的可行途径。更多还原

【Abstract】 After analyzing the limitations of the control by the existing financial supervision mode over the financial derivatives market, the author proposes a unified supervision mode, with a detailed discussion on its structure, system, foundation of performance and comparative advantages. On this basis, the author puts forward the plan for the legal system of a unified supervision. The first step is to set up a Coordination Committee on Financial Supervision as an interim form, then develop it into a unified supervision system gradually. The author concludes that this is a feasible way with lower cost for China.更多还原
