【摘要】 法官是通过适用法律解决案件和纠纷的国家官员,他们应该是公正的、廉洁的、有才能的和客观独立的。他们裁判案件的依据依照以往的标准只能是既有的法律规范或判例,审判的合法性来源于法律自身的逻辑周延性和规则体系的权威性。但现今,在面临多变和更趋复杂的新的社会矛盾和社会生活形式时;在寻求一个深层的社会共识的努力几乎是不可能成功的时候;在法律自治性渐渐瓦解、法律自身的一致性受到挑战的时候,法官应该具备的品行和才能有了更高要求,同时司法审判的合法性却受到了越来越大的质疑,法治的意义也遇到了从未有过的怀疑。法官与法治的这种密切关系以及当代法官该如何应对社会对他的角色期待,是本文将要探讨的主要问题。更多还原

【Abstract】 Judges are state officials who deal with the cases and mediate issues through using suitable laws. They should be just,honest,talented,objective and independent. According to former criteria the basis they judge the cases can only be established legal norms or legal precedents. The legitimacy of adjudication originates from logical distribution of law itself and the authority of rule systems. But now,as the new social contradictions and the new forms of social life become more complicated and changeful,it is impossible to seek a profound and widespread common view successfully. When the autonomous nature of law has collapsed and the identity of law itself has been challenged,judges should possess much more excellent morality and capacity. In the meantime,more and more suspicion is directed against the legitimacy of the judicial trying and the meaning of the rule by law. This article studies the close relationship between the judges and the rule by law,and shows that how the judges should respond to the social expectation of their role.更多还原
