【摘要】 讨论投标保证金和履约保证金的立法目的,投标保证金和履约保证金性质,分析投标保证金和履约保证金制度实施现状,提出健全投标保证金和履约保证金制度的建议:应由独立第三方(如银行)保管投标保证金,这样可以在一定程度上减小承包商所承担的投标保证金被挪用的风险,有利于保障合同双方的地位平等;履约保证金也可以提交给指定银行保管,这样该部分资金可以作为一种存款,为承包人带来一定的收益。这样做比直接将履约保证金交付给业主要好,可以避免中标方失去该部分资金的时间价值和承担被挪用的风险。但业主应向承包方提供工程款支付担保。更多还原
