【摘要】 目的研究脑器质性人格改变违法行为时辨认能力、控制能力的关系及影响因素。方法对62例脑器质性人格改变患者犯罪鉴定案例资料进行分析研究。结果影响其辨认能力和控制能力的主要因素有是否伴有智能障碍及程度、精神病性症状、意识障碍、作案动机及危害行为的关系等。结论责任能力的评定要满足医学要件和法学要件标准,案发时辨认能力和控制能力受多种因素的影响。更多还原

【Abstract】 Objective To explore the relationship between recognition and controlling capalities and their influenciny factors in patients with brain organic personality change. MethodsThe assessment data of 62 patients with brain organic personality chang were analysed. ResultsThe main factors influencing recognition and controlling capacities were with or without intellegent disorder,severity of intellegent disorder,psychotic symptom,conscious disorder,relationship between criminal motivation and criminal behavior. ConclusionThe assessment of responsibility should meet both medical and forensic criteria. Recognition and controlling capacities are influenced by many factors.更多还原
