【摘要】 彩票罪是外国刑法上的特定类罪,我国刑法上并无类似规定。鉴于我国已发生多起彩票违法犯罪重大案件的事实,外国刑法上的彩票罪对我国有效治理彩票犯罪具有积极的借鉴意义。为规范彩票的经营行为,防范犯罪,保障参与者的利益,彩票立法应当遵循市场经济规律和保护健康的经济生活风俗为原则。所以,它应当由具有递进关系的三个层次的立法构成:一是经济立法;二是行政立法;三是刑事立法,有关刑事立法的问题可参照德日等国的立法经验。更多还原

【Abstract】 Lottery crime is a special kind of crime in foreign criminal law, blank in China. Owing to the fact that several illegal major cases about lottery occurred in China, the lottery crime in foreign criminal law will have a positive effect on controlling lottery crime in China. To regulate lottery operation, prevent crime and safeguard benefits of clients, lottery legislation must follow market economy rules and the principle of protecting sound customs of economic life.
