当前医疗纠纷的主要原因与防范措施
Main causes for current medical dispute and its prevention measures
【摘要】 笔者依据社会学、心理学的理论,从社会政治、经济、文化、心理、法律角度分析医疗纠纷主要原因,认为医疗纠纷主要原因:(1)医疗行为的双刃效应;(2)医学模式转化过程中伴随的负面效应;(3)相关法制建设的滞后;(4)卫生资源分配不公;(5)不同群体对卫生服务质量评价标准不同;(6)医疗过程中的不正当补偿行为;(7)新闻媒体的不当炒作。其防范的措施:(1)重视医疗质量;(2)重视人文关怀;(3)合理进行成本调控;(4)强化医务人员的法律意识;(5)加强病案管理;(6)勿随意增加患者或家属对疗效的期望值;(7)维护患者的隐私权及知情同意权。认为构建以人为本的医疗服务,加强医务人员的医德修养,提高医务人员的业务素质,强化医务人员的法律意识,改进医疗单位服务意识、妥善处理医患关系,协调社会关系等,将有助于预防和减少医疗纠纷,从而达到医患关系的和谐。
【Abstract】 According to theory of sociology and psychology, the authors analyzed the main causes of medical disputes from the point of view of society, politics, culture, psychology and law. They concluded the main causes as follows: (1) two-edged effect of medical activity;(2)negative effect companying with the process of medical mode conversion;(3)lag of correlative law and regulations;(4)unfair allocation of medical resource;(5)different circles have different evaluation criterion;(6)improper compensation during treatment process;(7)improper propaganda of media’s report. The measures of prevention were: (1) emphasizing medical quality;(2)emphasizing humane concern;(3)controlling the cost reasonably;(4)intensifying medical staff’s consciousness about law;(5)enhancing the document management;(6)not increasing patient’s expectation towards curative effect at will;(7)protecting patients’ private rights and consent rights. The paper argued constructing human-centered medical quality, improving medical staff’s medical moral, improving medical staff’s professional quality, intensifying their consciousness of law, improving unit’s consciousness of unit, handling relationship between patients and medical staff properly and coordinating social relation could help to prevent and reduce medical disputes, thus better relationship between patients and medical staff could be achieved.
