【摘要】 经济全球化进程的加快要求我国健全经济法制,尽快制定反垄断法,对竞争领域的有关问题做出规定。经济全球化背景下我国反垄断法制定的宗旨,应该以统筹国内发展和对外开放为该法制定的指导思想;在全国设置统一的反垄断执法机构;反垄断法中应当对行政性垄断进行规制,但不应将其作为该法规制的重点,重点应在经济性垄断;我国的反垄断法应该在一定程度上确认域外适用效力,并针对知识产权领域限制竞争行为进行反垄断法的规制。更多还原

【Abstract】 The acceleration of economic globalization requires the formulation of the anti-monopoly law and the regulations of competition.China’s anti-monopoly law aims at developing domestic economy and pursuing the policy of opening to the outside world.The anti-monopoly law should include the regulations of executive monopoly and economic monopoly,but the emphasis should be put on the latter.The law should apply to other countries and the limitation of the competition about the intellectural property.更多还原
