民法社会化与中国民法的法典化
Socialization of Civil Law and Codification of the Civil Law of China
【摘要】 本文探讨了民法社会化现象,并论证了在这一背景下,我国民法典的制定采取以权利本位为主导,社会本位为辅的立法思想。
【Abstract】 In this paper,author inquire into the phenomenon of civil law and demonstrate that codification of the civil law of China should be guided by the ideal of giving priority to the right standard with the social standard as complement.
