【摘要】 目的探讨精神医学司法鉴定案例中民事行为能力鉴定的特点。方法对88例民事行为能力鉴定案例的相关鉴定资料,包括一般资料、案件类型、申请鉴定原因、鉴定结果等情况进行回顾性分析。结果民事行为能力鉴定案例占总司法鉴定案例的5.5%。88例鉴定案例中离婚纠纷62例(70.5%)。民事行为能力评定:完全责任能力占28.4%,限制责任能力占26.1%,无责任能力占45.5%。结论民事行为能力的司法精神医学鉴定案例偏少,但涉及的问题较复杂。更多还原

【Abstract】 Objective To explore the features of the forensic psychiatric expertise for civil competence. Methods Data about civil capability such as general data, case’s type, causes of expertise and results were retrospectively analyzed in 88 cases with expertise of civil capability. Results The expertise of civil capability made up 5.538% of the total cases of forensic expertise. Of 88 cases, 62 (70.5%) were about divorce’s dissension. Assessment of civil capability: 28.4% was complete, 26.1% restricted capability and 45.5% incapability. The more severe were mental diseases, the more marked the injury of civil capability. Conclusion The cases of forensic psychiatric expertise for civil capability were fewer, but complex.更多还原
