【摘要】 目的:探讨精神病人限定刑事责任能力评定量表扩展运用于刑事责任能力评定的可能性。方法:对刑事责任能力鉴定对象按量表手册进行评分,专家按3级和三等5级分别对研究对象的刑事责任能力给出评定意见,分别探讨量表在两种分级情形下的运用。结果:共纳入384例样本,全量表Cronbachα为0.932 2;条目内部相关性尚可,18个条目均与量表总分相关(r从0.157~0.904)。主成分分析提取3个因子,累积贡献率为68.62%。刑事责任能力3级时,无、限定、完全的量表总分分别为(9.66±5.11)分(、26.54±5.21)分和(40.08±7.90)分,具有显著差异,建立判别式,回代表明94%分类正确;当刑事责任能力三等5级划分时:无、小部分、部分、大部分、完全的量表得分分别为(9.64±5.10)分、(21.21±2.52)分、(25.26±4.05)分(、31.85±3.46)分和(40.58±5.92)分,具有显著差异,建立判别式,回代表明80.5%分类正确。结论:精神病人限定刑事责任能力评定量表构建合理,信效度较好,可扩展运用于刑事责任能力评定。更多还原

【Abstract】 Objective:To explore the extended usage of diminished criminal responsibility in patients with mental disorders rating scale. Method:The interviews were assessed by use of the rating scale,at the same time,the forensic expert given their opinion of the interviewes criminal responsibility by three and five grades respectively,then assess feasibility of the diminished criminal responsibility rating scale when used in criminal responsibility assessment by means of analysing the above data. Results:There are 384 cases,Cronbach α= 0.932 2,and all items have good correlation with the total score of the scale,r from 0.157 to 0.904.3 factors was extracted by the factor analysis,and their cumulative squared loadings is 68.62%.When the criminal responsibility was graded into three groups,the scores were(9.66±5.11)、(26.54±5.21) and(40.08±7.90) respectively,by establishing three discriminants,classification results suggested that 94.0% of original grouped cases were correctly classified.When the criminal responsibility was graded into five groups,the scores were(9.64±5.10)、(21.21±2.52)、(25.26±4.05)、(31.85±3.46) and(40.58±5.92),by establishing five discriminants,classification results suggested that 80.5% of original grouped cases were correctly classified. Conclusion:The diminished criminal responsibility in patients with mental disorders rating scale is good built and has good reliability and validity,it can be used well in the assessment of criminal responsibility.更多还原
