【Abstract】 That the operation of "open the brain to quit the poison" was ordered to stop stimulates public strong reaction , in which there are two opposite views. But the urgent matter of the moment is not who is right or wrong. What we need to do is to protect the right of people health, and change the very asymmetric present condition of information between patients and doctors, improve the personnel construction of medical science ethics committee. The expert’s natural intelligence should be standardized according to the law. The unified procedure of investigation should be established. The legal responsibility of investigation behavior should be clear.
