【摘要】 依据我国《海商法》的有关规定,认为互有过失碰撞的船舶对其造成的船员、旅客的人身伤亡应该承担连带责任,同时对船员与旅客的人身伤亡的法律救济及责任限制进行了论述。对于船员而言,不同的诉因将导致不同的赔偿责任和责任限制的适用。对于本船旅客侵权索赔,本船可以在责任份额内适用责任限制,而他船不能援引责任限制,并承担连带责任。更多还原

【Abstract】 Based on the Maritime Code of the People’s Republic of China,ships should be jointly and severally liable to the loss of life or personal injury. The paper further makes a study on ship’s liability and the applicable of limitation of liability. As for the crew’s claim,the choice of the cause of action determines the scope of liability and the applicable of limitation of liability. In respect of the passengers’ tort litigation,their ship may limit liability in her proportion;another ship may not limit her liability and should be jointly and severally liable for loss of life or personal injury.更多还原
