【摘要】 目前国际国内立法已逐步承认电子技术在商事领域可以实现传统纸质媒介的相关功能 ,有的甚至直接规定“书面形式”包含“电子形式” ,但就提单立法而言 ,目前尚普遍要求提单应具备纸质形式。这使得提单的电子化只能另辟蹊径 ,通过当事人之间的约定予以实施。不过各国立法逐步承认电子签名和电子证据的法律效力 ,使得电子提单的法律效力可得到保证。更多还原

【Abstract】 Now international and national legislations have gradually accepted that electronic technology can realize the legal functions of papers in commercial transactions, and some even accepted that “writing" includes “electronic form". But as far as B/L is concerned, most of the legislations still require that B/L be issued on papers. So digitalization of B/L has to be implemented according to the contracts between the partners. And because of the gradual acceptance of the legal effect of electronic signature and electronic evidence, the legal effect of electronic B/L will be guaranteed.更多还原
