【摘要】 公共利益的引入使财产权具有了社会性,它为公用征收权力的存在和运行提供了坚实的理论基础,并使之成为一项普遍的宪法制度和政治实践。财产权神圣观念的丧失并不意味着可以对财产权任意地施加限制与剥夺,只是在承袭近代财产权保障制度合理内核的前提下,征收补偿制度的建立才具有了客观依据。事关公共利益与私人利益价值判断的做出只有建立在对二者公平衡量的基础上,方能真正保障公民的财产权等基本权利。行政补偿制度的建立就是该大背景下的关键一环。更多还原

【Abstract】 The sociality of property right provides a solid theoretical foundation for the existence and operation of public expropriation power. It also makes it a universal constitutional system and political practice. Although modern constitution has deprived of the holy concept of property right, casual imposition on property right is never allowed. Based on the inheritance of the reasonable content of property right guarantee system, administrative compensation system with well-designed structure and procedure is established. The rational measure to guarantee the basic right of the citizen, especially the property right, should be established on the equally balancing between the public interest and private benefits.
