【摘要】 孟德斯鸠最有影响著作自是《论法的精神》,其中大量文字是对中国法律的评述 ,在很大程度上把握了中国传统法律的一些基本特征。孟德斯鸠论述中国传统法律文化的主要原因 ,在于中外交流的频繁 ,对外来文化的借鉴 ,更出于其自身理论架构的需要。其对中国法律的阐述不仅影响外国人对中国传统法律文化的看法 ,也影响中国人对自己文化的观感更多还原

【Abstract】 The most influential work by Montesquieu is the Spirit of Law, where there are a great deal of comments on Chinese law. They have a lot of relevance to the fundamental characteristics of Chinese legal culture. The reason underlying the size of contents extended to Chinese law is not only the cultural exchanges between China and other counties, but the need of framing theory. Montesquieu’s elaboration on Chinese law not only impacts the foreigners’ understanding of China’s conventional legal culture, but the Chinese perspectives toward the culture of their own.更多还原
