【摘要】 CEPA是我国参与区域经济一体化的重要步骤 ,其第 7条规定内地与香港之间互不实施反倾销措施。香港自由港的地位使我们有理由担心在 CEPA零关税下来自第三方的产品可能涌入内地进行低价倾销 ,即 CEPA下的中国内地与香港之间存在发生倾销的贸易风险。CEPA及我国的反倾销法律制度主要依据原产地规则对此进行了防范 ,但依然存在漏洞 ,应该加以完善更多还原

【Abstract】 CEPA is one of the most important steps for China to participate in regional economic co-operation, however, Art.7 of CEPA rules that anti-dumping measures should not be applied between China’s mainland and Hong Kong. Being a world free-port, Hong Kong is the place for some foreign entrepot trade, which may later enter into China’s mainland’s market under the free-tariff of CEPA. That is, here are some possibility of dumping between Hong Kong and China’s mainland. Focusing on this point, this paper analyzed the possible risks and measures can be taken currently both in CEPA and the anti-dumping legal systems in China. In addition, the author questioned the deficiencies in some anti-dumping legislations, as well as put forward some meaningful suggestions.更多还原
