【摘要】 从资源配置角度看,大学具有聚集高等教育资源的功能,大学制度是资源产权主体之间的契约集。广义上的大学制度包括大学法人制度和大学教育制度。本文所指的大学制度即大学法人制度,是关于大学财产的设立、责任承担中的责权利关系,其核心也就是大学的产权制度,是大学制度中的重要组成部分。本文从大学制度的基本属性出发,提出了大学制度的纵向两层结构和横向的三种形态,并对我国民办教育的属性、发展路径作了分析。更多还原

【Abstract】 From the distribution of resources angle, the university has the function of assembling the resources of higher education.The university system is the collection of contracts among the subjects of the property rights. In general, the university system includes the system of university legal person and the system of the university education. The university system in this essay refers to the system of university legal person.It is about the establishing the property of university and the relations among responsibilities,rights,interests of the responsibilities during the assumption. The core of the university system in this essay is the system of ownership. It is an important part in the university system.
