【摘要】 海峡两岸的司法解释制度虽同宗同源 ,但在解释的主体、对象、程序、效力、功能及司法解释与判例的关系等方面却存在极大的差异。两岸政治文化传统上的同宗同源以及法律制度与精神上的传承关系的共同性 ,决定了台湾地区的司法解释体制可以成为我国司法解释乃至整个法律解释体制改革的他山之石。更多还原

【Abstract】 The judicial interpretation systems in two areas of the strait are of the same clan and origin, but they are largely different in many aspects.
