【摘要】 从分析校生之间的法律关系入手,结合新颁布的《普通高等学校学生管理规定》,就学校行使管理权的适法性、学生权利保护、民主管理与学生自治等几个问题进行了探讨。文章认为,学校在依法行使有关学生受教育权的获得或丧失的权力时,应适用“法律保留”原则,并有必要引入司法审查制度。学校应对现有的校规进行修订,并设立内部权利救济机制,以保护学生的合法权益。文章还对保障学生的诉权、民主管理与学生自治提出了意见和建议。更多还原

【Abstract】 The article has discussed several problems such as legitimacy of universities exerting administration power , students rights protection , democratic administration and students autonomy proceeding with law relation between universities and students and combining the newly issued stipulations on university students administration. The article has following viewpoints: First, it’ s necessary to introduce the judicial review system and we should apply to the principle of legal reservation when universities exert power on achieving or losing of students being educated rights by law ; Second , Universities should edit the existing university regulations and set up inner relief mechanism to protect students legal rights. Furthermore, the article has put forward ideas and suggestions about guarantee of students lawsuit right , democratic administration and students autonomy.更多还原
