【摘要】 阐述了不公平格式条款的表现形式,分析了“霸王合同”产生及泛滥的原因。认为认定格式条款的不公平,包括如下要件:合同条款有违公平原则,条款提供方有过错,合同相对方利益受损。规制“霸王条款”,既要加强法律规制和行政措施,也要鼓励社会力量加入监督,还要重视市场结构的调整。更多还原

【Abstract】 This article argues that the reasons why unfair format clauses exist widely are not only the inherent abuse of market economy,but also the problems in our country.The unfair format clauses include such clauses as enlarged the province of free duty,or relieved the fundamental obligation of the party who offers the clause,or transferred risks by using juberous items.The author also analyses how to judge whether a clause is unfair and ways to avoid them.更多还原
