【摘要】 在人地关系高度紧张的情况下,土地不仅是农业最基本的生产资料,也是农民最基本的生活保障。由此决定了耕地配置的公平原则必然高于效率原则。与我国工业化、城镇化相联系的农用土地转为建设用地的过程,应当是农民共享工业化、城镇化成果的过程。我国农村土地征用制度应当体现赋予农民土地保障功能。土地保障是农村社会保障严重短缺情况下应运而生的一种特殊保障形态。为了促进我国工业化、城镇化以及农业产业化的健康发展,客观上要求必须逐步用社会保障取代土地保障,促使土地由双重功能向单一功能(即生产要素功能)演变。更多还原
