【摘要】 我国城市房屋拆迁制度是一项重要的公共政策制度,也是一个学术界非常关注的城市环境经济学问题。当前城市拆迁中存在许多问题。导致城市拆迁纠纷的经济学成因在于我国城市房屋拆迁行为的制度障碍和政府、拆迁商及被拆迁者利益博弈的本质;在行政权力未能受到法律有效制衡的条件下,政府也无法对拆迁利益受害者实现应有的实质性保护。因此,必须从引入市场机制、加强住房保障体系建设、制约拆迁许可行政职权和强化对拆迁商拆迁行为的监管等方面来完善我国城市房屋拆迁制度;通过完善城市房屋拆迁理论体系和管理体系来推动城市拆迁工作。更多还原

【Abstract】 The urban house demolition system is an important public policy system in our country,and it is the urban environment economic knowledge question that academic circle pays close attention to,too.A lot of questions exist while the urban house demolition at present including the dispute of the urban house demolition.In essence,the dispute of the urban house demolition is an interest games among government,office to dismantle the urban house and the resident ready to move with their house to be dismantled,and the institutional defects of the urban house demolition behavior,and then the government is unable to offer due and substantive protection to the interests victim of the urban house demolition on terms that administrative power fails to be checked and balanced effectively by the law.Therefore,to perfect the urban house demolition system must be to introduce the market mechanism,strengthen to build the security system of the house,restrict the urban house demolition’s administrative power,and strengthen to supervise the demolition behavior of office to dismantle the urban house.At the same time,promote the urban house demolition through perfecting the theoretical system and management system of the urban house demolition.更多还原
