【摘要】 我国目前的法院调解基本是在审判庭和法院闲置的房间进行。法庭深色调的装饰、法庭的三角形的结构以及构成这一结构的物质形态给参与调解的人以敌对的、忧郁的情绪;闲置房间的狭小、拥挤和阴暗、简陋,使人紧张不安、不愉快、中断注意力,急于尽快离开;这样的调解场域不利于调解的成功。法院应当设置客厅化的专用调解室。更多还原

【Abstract】 A large percentage of the court mediation in our country are held in a vacant room just beside the sentence court or in the courthouse. According to the non-verbal communication theory, the dark decorations in the court, the triangle structure of the courthouse, as well as the material association with this structure are most likely to produce a hostile and gloomy mood among the people involved into the mediation. The vacant room is usually small, gloomy, crude, and crowded with the parties in action, so the persons involved often feel upset and irritated, and hard to be concentrated, and eager to leave the place. It is quite out of the problem to have a satisfactory result in such a field of mediation. Thus it is necessary for the court to set a special and saloonized mediation room.更多还原
