【摘要】 最高人民法院和最高人民检察院关于民事检察员出席再审法庭的任务之司法解释是相互矛盾的。检察员出席再审法庭的任务是:(1)宣读抗诉书;(2)发表出庭意见;(3)发现庭审活动违法的,向再审法院提出建议。建议由全国人大就此做出权威的立法解释,并说明理由。更多还原

【Abstract】 The two legal interpretations of the tasks of civil procurators in reopening a case issued by the Supreme Court and the Supreme People’s Procuratorate are contradictory. It is proposed that civil procurators in reopening a case should (1)to read aloud the written protest: (2)to declare the viewpoints in court; (3)to suggest the court to adjust the unlawful retrial activities. It is expected that the National People’s Conference make an authoritative interpretation or legislation to solve this problem.更多还原
