【摘要】 我国公共秩序保留制度相当完善,但仍存在一些疑难问题不能根本解决。一个根本的原因,就是没有很好的把握国际私法基本精神的走向。文章将从国际私法基本精神从“主权优位”到“平位协调”的转换方面,对我国公共秩序保留制度的发展方向加以定位,从而提出了对我国公共秩序保留制度的适用,在立法实践中加以限制和改善的建议。更多还原

【Abstract】 The institution of the reservation of public order in our country is quite well-provided,but still some difficult problems can not be settled.A basic reason is we have not clutched the direction of the basic spirit of private international law very well.This article will define the post for the direction of the development of the institution of the reservation of public order in our country from the aspect of the basic of sprint of private international law,transitioning from precedence of sovereignty to equal status’s cohesion,then put forward the advice of confining and refining about the institution of the reservation of public order in our country in legislation practice.更多还原
