【Abstract】 Governmental purchase contract is presented in civil contract form, which reflects assets relationship between the equal subjects,thus has the features of priviate law. Satisfying the governmental will and social public benefits are its essentials and which has the key characters that are different from civil contract. Governmental purchase contract has key means in which the governmental macro-controls, uses the finance and disposes the social resource.
