【Abstract】 The right of claim plays a role of right realizing,protecting and relieving .According to its purpose,there are supervisal claim,protecting claim and compensative claim .While according to its validity situation ,there are covert claim and overt claim .The right of claim is different from creditor’s right.Actually speaklly,creditor’s right is a right of acceptance .The result of tort is the right of claim-liability ,which is the second kind of right and obligation oppsed to the first ones,not obligations arising from tort.更多还原
