【摘要】 本文试图运用哲学意义上的自由概念,阐明韦伯法律统治类型学说的价值。通过韦伯统治类型和法律理性化类型的阐释,说明所谓"英国法问题"的实质和意义。现代性社会的个人自由受到伦理理性化和社会理性化的双重压力,而英国普通法传统虽然有着较低水平的理性化,却为个人自由的伸张开拓了舞台,使本来日渐孱弱的自由又有了生存的空间。自由重新回到意义的核心,社会制度的正当性重新得到了自由的辩护。更多还原

【Abstract】 The paper attempts to explore the value of Weber’s types of legal domination by using the philosophical concept of freedom. It explains the substance and significance of the socalled "the problem of England" by exploring the Weberian types of domination and the rationality of law. In a modern society, the freedom of an individual is under the dual pressure from ethical rationality and social rationality. Although the common law tradition of England has low rationality, it provides room for the promotion of freedom of individual, which makes room for the waning freedom to survive. In this way, freedom becomes the core of meaning once again and the justification of social system is redefended by freedom.更多还原
