【Abstract】 Procreate right is a natural right and one of the basic human rights, but the exertion of procreate right differs from other civil rights. The implementation mode of procreate right is influenced by many factors, such as social and ethic elements. So procreate right is necessarily ruled by law, which should be exerted by both husband and wife.
