【摘要】 “非典”以及“禽流感”等传染病疫情爆发 ,其间暴露出我国刑事立法的不足。传染病防治失职罪存在诸多立法上的缺陷。对此 ,应扩大主体适用范围 ,明确主观方面为过失 ,完善法定刑 ,增加对传染病防治中滥用职权的规定更多还原

【Abstract】 The appearances of the epidemic situations of infectious disease, such as SARS and “poultry flu", etc., exposing the deficiency of the criminal legislation of our country. Offenses of misconduct in office of infectious disease prevention and cure have a great deal of legislative defect. As to this, first, the scope of application of subject should be expanded, second, the fault of subjective respect should be defined clearly; third, legal punishment should be perfected,at last,the action of abusing one’s power should be regulated more while preventing and curing the infectious disease.更多还原
