【摘要】 群体诉讼在美国称为集团诉讼、日本称为选定当事人诉讼、德国称为团体诉讼,这些制度各有长处,都为快速妥当解决环境纠纷、控制环境污染、保护受害人环境权益方面起到了积极的作用。在借鉴国外先进经验基础上,我国应当在放宽对代表人权限过多限制、确立民间环保团体组织诉讼地位、加强集团诉讼政策制定功能等方面完善我国环境诉讼中的代表人诉讼制度。更多还原

【Abstract】 On the basis of the comparative research of the class action of US, party alternative action of Japan and group action of Germany. All of them have their advantages, for example, resolving the dispute, controlling the pollution, protecting the environmental right of person.
