【摘要】 对“国内产业”范围的界定是反倾销理论和实践的一个重要课题 ,虽然根据WTO的《反倾销守则》的要求 ,各国的立法作了类似的规定 ,但都是比较宽泛的 ,在反倾销实践中 ,各国当局拥有较大的自由裁量权 ,而尤以美国和欧盟在这方面比较成熟。本文围绕有关确定“国内产业”范围的三个主要方面 ,对美国和欧盟就“国内产业”界定的有关规定和实践做法进行了介绍和分析 ,以对我国反倾销制度中“国内产业”范围界定提供参考和帮助更多还原

【Abstract】 The definition of the scope of “domestic industries”is an important issue for the theory and practice of anti-dumping. Although the WTO has made certain requirements in its Regulations Concerning Anti-dumping and similar measures have been taken in some countries, they are quite general and vague. In practice, each country has much power to make their judgments, especially America and the EU. This paper introduces and analyses, from three angles, the regulations and practice regarding the scope of domestic industries in America and the EU, and proposes something for China in this respect.更多还原
