【摘要】 基于国内学者对监护人责任的性质与归责原则纷争现状 ,作者在明确监护人责任概念的基础上 ,大量借鉴欧洲大陆国家相关理论 ,运用比较分析等研究方法 ,认为监护人责任的归责原则 ,应摒弃无过错原则 ,采用过错或过错推定原则。只有这样才能体现现代民法保护未成年人等弱者的法律思潮更多还原

【Abstract】 With dispute over the nature of duty of guardianship and doctrine of liability fixation, the author defines the concept of duty of guardianship, and, by using related theories from the continental countries in Europe, agrees to the application of doctrine of negligence or doctrine of presumptive negligence instead of doctrine of non-negligence in order to realize the idea in the modern civil laws.更多还原
