【摘要】 国家赔偿采取的是违法归责原则。对存疑不起诉案件应否给予刑事赔偿 ,实践中做法不一 ,理论上存在分歧。存疑不起诉的被不起诉人被逮捕的 ,应考察逮捕时的正当性。如错误逮捕的 ,国家承担对被不起诉人的赔偿责任 ;如逮捕是依法进行的 ,国家应当免除赔偿责任。更多还原

【Abstract】 Country compensation follows the rule of the violator’s responsibility. As regard to the criminal compensation of nonprosecution cases with doubts problems exist both in practice and theory. When the person in the case is arrested the justice of the arrestment shall be checked. If he is arrested wrongly the country shall take the charge of compensation;if arrested in accordance with the law the country shall relief against compensation.更多还原
