【摘要】 鉴于银行抵消涉及到的法律关系复杂多样 ,且目前世界各国对银行抵消的性质看法不一 ,使得各国在银行抵消的法律适用问题上看法不一。就此借鉴国外经验 ,从银行抵消的效力来源和性质着手 ,来建构我国银行抵消的法律制度 ,是解决该问题的有效途径更多还原
