【摘要】 国外有组织犯罪在我国被称为黑社会犯罪。我国当前立法所规定的"黑社会性质组织罪"与黑社会组织罪除了组织化程度不同外,并无罪质的根本区别。建议在司法中按"包含更恶"的刑法原则将事实上已经存在的"黑社会组织罪"直接纳入"黑社会性质组织罪"定罪科刑,在立法修改时将"黑社会组织罪"与"黑社会性质组织罪"规定为同一罪名。更多还原

【Abstract】 The organization crime in other countries is called underworld crime in China. The author believes that the organization crime in the nature of criminal syndicate and underworld crime are the same except in the level of organization. For the time being,we may follow the principle of "including more severe crimes", and put underworld crime under "the organization crime in the nature of criminal syndicate". When revising the laws ,we should combine the two instead of separating them.更多还原
