在控权与管理之间:中国高等教育行政的法理学取向

【摘要】 学术创新取决于学术自由的实现 ,学术自由能否实现的关键则在于教育行政与学术自由能否相互协调。学术自由的实现既需要限制教育行政的膨胀 ,同时又离不开教育行政的参与。教育行政的理论模式主要有控权论与管理论。控权论主张控制教育行政权力 ,保护学术自由与大学办学自主权 ;管理论强调维护教育行政特权 ,学术自由没有完全进入决策者的视野。教育行政的平衡论为学术自由与社会干预的整合提供了法理学基础 ,它为学术自由的实现提供了一条思考的路径

【Abstract】 Academic creation depends on the realization of academic freedom. The realization of academic freedom is decided by whether education administration and academic freedom are well coordinated. On the one hand, inflated education administration must be restricted. On the other hand, the realization of academic freedom needs education administration. The theory of education administration comprises the theory of confined power and the theory of management. The theory of confined power holds that we must confine the power of education administration in order to protecting academic freedom and academic autonomy. On the contrary, the theory of management advocates that the privileged position of education administration should be defended as underestimate the value of academic freedom. The theory of balance between education administration and academic freedom offer the base of jurisprudent for conformity between academic freedom and social interference.
