【Abstract】 The idea of law is a primary issue to the construction of legality, and to the studying of jurisprudence also. Contrasting with the ways of western several main school, we are persisting in the idea of legal positivism and lacking a pursuit of moral value inside law. However the law should be attached with moral pursuing. Modern idea of law should be the right\|oriented one. Therefore, the law should be a sum of authoritative criterions, which are established and certificated by the state to rationally distribute social rights.更多还原
